These General Conditions of Use, Conditions of Sale and Privacy Policy regulate the use of the website www.deprofundis.es, of which DE PROFUNDIS, S.L. with CIF: B62426184 and address at: C/ Castellgalí 22 Post Code: 08295 Town: St. Vicenç de Castellet Province: BARCELONA is the owner.
TERMS AND CONDITIONS
1. PURPOSE
The purpose of these Terms and Conditions of purchase is the supply by De Profundis S.L. of the products offered in its online stores, in exchange for a financial benefit.
By accessing our portal, the Client agrees to respect the Terms and Conditions as well as the rules of use that appear therein.
2. COMPONENTS OF THE CONTRACT
These Terms and Conditions, together with the order confirmation, constitute the contract between De Profundis S.L. and the Client for the supply of the products. No other different texts will apply.
The Client will be deemed to agree with the general conditions provided in this text from the moment that he/she accepts that he/she has read and agrees with these Terms and Conditions and does not expressly express his/her disagreement.
3. PLACING AN ORDER
In order to place an order, the Client must be at least 18 years of age. If he/she is a minor, he/she must ask his/her parents or legal guardians to place the order on his/her behalf.
However, if he/she is between 14 and 18 years of age, he/she can request information about products and events. In any case, it is recommended that the Client has his/her parents or legal guardians before browsing and/or registering in our online store so that they can explain any questions that may arise.
If the Client is under 14 years of age, please do not provide us with any personal information, as we cannot accept it.
Once the Customer has accessed the online store, he/she must fill out the form with the necessary personal data requested and click on the 'complete order' button to confirm the purchase.
When the Customer completes his/her order, we will send him/her an email with the number and details of his/her order.
If there is a problem with the shipment of the material, we will contact the Customer as soon as possible to inform him/her of the situation and suggest alternative products that he/she may wish to purchase. Or propose the return of the sum of money that he/she has paid us for such products.
The Customer may cancel the order at any time and without any additional cost, provided that it has not been invoiced and sent through the transport company.
In cases of orders for special items, De Profundis, S.L. may require a deposit of up to 50% of the total amount at the time of confirmation of the order.
Any claim must be made within a period of no more than 48 hours from receipt of the merchandise.
The availability of products on the website is constantly changing and reflects the real-time situation. Adding an item to the shopping basket does not guarantee that it will be reserved for the Customer, as other customers may have purchased it while browsing the website. Only when the payment process has been completed is the product effectively reserved for the Customer.
We will make every effort to supply the products listed in your order confirmation. However, there may be occasions when we are unable to supply such products due to, for example, the products not being in stock. In such cases we will contact the Customer to inform them and may suggest alternative products that they may wish to purchase.
4. SUPPLY OF PRODUCTS
De Profundis S.L. will supply the products listed in the Customer's order confirmation in accordance with these Terms and Conditions.
5. PRICES AND SHIPPING COSTS
The price of each product will be clearly stated in the online store. DE PROFUNDIS S.L. reserves the right to modify prices in the event of market fluctuations or typographical errors, and may cancel or annul an order upon detecting the error.
We reserve the right to charge for the order from the moment it is received.
All sales prices indicated in our online store include VAT.
Shipping costs are not indicated in the price of the products. Shipping costs are the responsibility of the Customer and will be added to the total amount of the selected products. The Customer can check the amount of shipping costs at any time in the shopping cart, before confirming the order and completing the contracting process. The calculation of shipping costs depends on the volume and weight of the items.
In the case of a return due to a change of size, model, color, or product... shipping costs will be the responsibility of the customer.
Import charges for shipments to the Canary Islands:
Shipments to the Canary Islands are subject to the payment of import and/or local customs taxes. Orders are sent via Correos.
6. AVAILABILITY OF PRODUCTS
The Customer must take into account that orders will be sent within the limits of available stock. If one of the ordered items is not in stock, we undertake to send the Customer an email as soon as possible (from the date on which the order was placed) to inform them of the time frame in which we will be able to send their product(s). If they are not interested in waiting, they may request a refund of the amounts they have paid for said item.
7. PAYMENT OF PRODUCTS
Our main payment methods are Credit/debit cards and Bank Transfer. Once all the items have been added to the basket and the courier service has been selected, all available payment methods will be displayed.
The Customer always has the right to receive the invoice in paper form free of charge, although if he/she does not state otherwise in his/her order, we will understand that he/she expressly agrees to receive it electronically (by e-mail). This consent may be revoked by the Customer at any time by contacting our Customer Service team, through the contact section.
8. DELIVERY OF PRODUCTS
When placing an order, the Customer can choose his/her delivery option once all the items have been added to the basket. De Profundis S.L. will send the order to the address provided by the Customer when placing his/her order. To ensure the safe delivery of the package, the courier company needs a signature to confirm that the delivery has been successful. If there is no one to receive the package, the driver will attempt a new delivery. In the event that the package cannot be delivered due to any reason, such as incorrect address, absent recipient, rejection of the package, etc., the package will be returned to our warehouse. Please note that we can only refund the price of the product paid for once the package has arrived back at our warehouse. The Customer will receive a refund of the price of the product paid for using the same payment method used when placing the order. In this case, shipping costs will not be refunded.
9. PRODUCT WARRANTY
As an official distributor of each brand, all items sold by De Profundis S.L. are covered by a 2-year manufacturer's warranty. If any of the purchased products suffer from a manufacturing defect, detected within 2 years from the invoice date and the defect has been confirmed by the manufacturer, we undertake to repair it free of charge, to replace it with a new one alternatively or to make the corresponding payment, including the resulting shipping costs. In the event that the problem with said product does not correspond to a manufacturing defect and is not covered by the warranty, it will be the Customer who pays all additional costs, including those of said return.
Batteries for flashlights, spotlights, scooters and other products that use them have a 6-month warranty.
10. RETURN OF PRODUCTS AND WITHDRAWAL
If the Customer is not satisfied with the product they have purchased, they may return the product to us and obtain a refund of the price of the returned product within 15 days of delivery of the products. On the other hand, only items that have not been used are accepted.
Once the merchandise has been returned to our warehouse and its condition has been checked, the amount will be refunded in accordance with the payment method used by the Customer.
The Customer has the right to withdraw from their purchase within 14 calendar days of delivery of the products, unless it is an exclusion provided for in the General Law on the Protection of Consumers and Users.
To exercise the right of withdrawal, the Customer must notify the sales department of De Profundis, S.L. by contacting us via email at comercial@deprofundis.es
11. OBLIGATIONS OF DE PROFUNDIS SL AND THE CUSTOMER
De Profundis S.L. undertakes to make available to the Customer all the necessary information regarding the products and orders. De Profundis S.L. does not guarantee the execution of these conditions in the event of force majeure, in the event of the Customer's absence or an unforeseeable event by a person not involved in the contract.
The Customer undertakes to fill out the order forms and their fields according to the instructions indicated. De Profundis S.L. will protect the data in accordance with the law. The Customer also undertakes to pay the price of the product, with the corresponding taxes and shipping costs.
We remind you that it is advisable to keep a copy of the data contained in the purchased products. De Profundis S.L. De Profundis S.L. is not responsible for any loss of data, files or, in general, any damage that may result from a failure by the Client to back up the data contained in the purchased products.
De Profundis S.L. is not responsible for the consequences that may result from inappropriate use of the products sold in its online store.
12. PROTECTION OF PERSONAL DATA AND COMMENTS
The personal data that the Client must provide us are essential for sending orders and preparing invoices. The absence of this data will lead to the automatic cancellation of orders. By registering on the page, the Client agrees to provide us with valid personal data, data that allows the provision of the service by De Profundis S.L. and the correct identification of the registered Client, as well as the sending of information and advertising of the different products and offers that De Profundis S.L. may have in its online store.

13. INTELLECTUAL PROPERTY AND COPYRIGHT
All content available in the De Profundis S.L. online store (illustrations, texts, names, own brands, images, videos, etc.) is the property of De Profundis S.L. Third-party brands are the property of their owners. Any partial or total reproduction of the content by any means and on any medium is subject to prior and express authorization from De Profundis or the rights holders, where applicable.
14. MODIFICATIONS TO LEGAL NOTICES
De Profundis S.L. reserves the right to modify this Legal Notice without the express acceptance by the User being a prerequisite. The modifications introduced will be understood to be tacitly accepted by the User if the User continues to access the Website from the date of publication of the aforementioned modifications. Otherwise, the User must immediately cease accessing and/or using the pages.
15. APPLICABLE LAW AND JURISDICTION
This contract shall be interpreted and governed in accordance with current Spanish legislation.
The parties agree, for the resolution of conflicts and waiving any other jurisdiction, to submit to the Jurisdiction of the Courts and Tribunals of Barcelona (Spain).
